1. Acceptance of These Terms

These Terms of Service ("Terms") form a legally binding agreement between you ("you," "your," or "user") and BoostLink Network ("BoostLink Network," "we," "us," or "our") and govern your access to and use of our website, landing pages, forms, and related online services (collectively, the "Site").

By accessing the Site, submitting a service request, or otherwise using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not use the Site.

2. About BoostLink Network

BoostLink Network is a home services marketing and lead-generation company operating in the United States. We connect homeowners seeking home services with independent local service providers in four core categories: HVAC (heating and cooling), plumbing, water damage restoration, and appliance repair.

BoostLink Network is not a contractor. We do not perform, provide, supervise, inspect, or warrant any home service work. We do not employ the technicians or companies who contact you. We are not a party to any agreement you enter into with a service provider, and we do not act as your agent or as the agent of any provider.

Our role is limited to facilitating an introduction: we collect your service request and route it to independent providers who may be able to assist. Everything that follows — including assessment, pricing, scheduling, performance, and warranty of the work — is between you and the provider you choose to engage.

3. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract to use the Site or submit a service request. By using the Site, you represent and warrant that you meet these requirements and that all information you provide is accurate, current, and complete.

If you submit a request on behalf of another person or on behalf of a property you do not own, you represent that you are authorised to do so and to provide that person's information to us and to participating service providers.

4. Permitted Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Submit false, misleading, or fraudulent information, or submit a request that is not a genuine enquiry about a real property or a real service need.
• Submit a request using another person's identity or contact details without their authorisation.
• Use automated means, including bots, scrapers, spiders, or scripts, to access the Site or submit requests.
• Attempt to gain unauthorised access to the Site, its servers, or any connected systems, or interfere with the Site's operation or security.
• Introduce viruses, malware, or any other harmful code, or engage in any activity that imposes an unreasonable load on our infrastructure.
• Reproduce, republish, distribute, sell, resell, or exploit any portion of the Site or its content for commercial purposes without our prior written consent.
• Use the Site in violation of any applicable federal, state, or local law or regulation, including laws relating to telemarketing, unsolicited communications, or consumer protection.
• Use the Site to harass, threaten, or harm any person, or to post or transmit unlawful, defamatory, or obscene material.

We reserve the right to suspend or terminate your access to the Site, and to decline to process any request, at any time and without notice if we believe you have violated these Terms.

5. Service Requests

When you submit a service request, you are asking us to attempt to connect you with independent local providers who may be able to assist with your request. Submitting a request does not create a contract for services between you and BoostLink Network, and it does not obligate you to purchase anything.

You understand and agree that:

• We may share the information you submit with one or more participating service providers and marketing partners so that they can respond to your request, as described in our Privacy Policy.
• Providers may contact you by telephone, text message, or email using the contact details you provide.
• We may be unable to match your request if your location, service category, or timing falls outside the coverage of our network.
• We do not verify the accuracy of information provided by providers beyond our standard onboarding review, and we do not guarantee any particular outcome.
• You are solely responsible for evaluating any provider you choose to engage, including verifying licensing, insurance, references, and qualifications.

6. No Guarantee of Service Provider Availability

BoostLink Network does not guarantee that a service provider will be available for your request. Provider availability varies by location, service category, time of day, and demand, and is entirely outside our control.

Specifically, and without limitation, we do not guarantee:

• That any provider will be available in your ZIP code or service area;
• That any provider will contact you, or that contact will occur within any particular time frame;
• That any provider will be able to perform the work you require, or will provide a quote;
• That any quote you receive will be competitive, accurate, or consistent with the final amount charged;
• That any provider will be licensed, insured, or in good standing in your jurisdiction, beyond our standard onboarding review;
• That the work performed by any provider will meet your expectations, applicable codes, or industry standards.

The Site is not an emergency service. If you are experiencing an emergency — including an active gas leak, flooding, fire, or any condition posing an immediate risk to safety — contact the appropriate emergency services or a local emergency contractor directly. Do not rely on the Site for urgent assistance.

7. Independent Providers

Service providers and marketing partners in our network are independent businesses. They are not our employees, agents, joint venturers, or partners, and nothing in these Terms creates an employment, agency, franchise, or partnership relationship between us and any provider.

Providers are solely responsible for their own licensing, insurance, permits, workmanship, pricing, scheduling, invoicing, warranties, and compliance with all applicable laws. Any dispute arising from work performed or not performed by a provider is between you and that provider. You agree to pursue any such dispute directly with the provider and not with BoostLink Network.

8. No Professional Advice

The content on the Site — including service descriptions, category information, and general guidance about common home issues — is provided for general informational purposes only. It does not constitute professional, technical, engineering, legal, insurance, or safety advice, and it should not be relied upon as a substitute for an on-site assessment by a qualified professional.

You should not attempt to diagnose, repair, or modify any gas, electrical, plumbing, HVAC, or structural system yourself based on information found on the Site. Improper work on these systems can cause injury, property damage, or death.

9. Pricing, Estimates, and Fees

BoostLink Network does not charge homeowners a fee to submit a request, to be matched with providers, or to receive quotes.

We do not set, control, negotiate, or approve the prices charged by providers. Any pricing you receive comes directly from the provider, and any agreement for work is strictly between you and that provider. We are not responsible for the accuracy of any estimate or quote, for any change in price, or for any charges you incur.

10. Communications Consent

By submitting a service request, you consent to be contacted by BoostLink Network and its participating service providers and partners by telephone, text message, and email regarding your request, including contact made using automated technology, as described in our Privacy Policy. Consent is not a condition of purchase. Message and data rates may apply.

You may withdraw this consent at any time by replying STOP to a text message, using the unsubscribe link in an email, or contacting us at boostlinknetwork@gmail.com.

11. Intellectual Property

The Site and its contents — including text, graphics, logos, icons, page layouts, design elements, and the "BoostLink Network" name and marks — are owned by or licensed to BoostLink Network and are protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the Site for your own personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, publicly display, republish, sell, or create derivative works from any part of the Site without our prior written permission. All rights not expressly granted are reserved.

12. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOOSTLINK NETWORK DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (A) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) THE INFORMATION ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT; (C) ANY REQUEST WILL RESULT IN CONTACT FROM, OR ENGAGEMENT OF, A SERVICE PROVIDER; OR (D) THE QUALITY, SAFETY, LEGALITY, OR STANDARD OF ANY WORK PERFORMED BY ANY PROVIDER WILL MEET ANY PARTICULAR STANDARD.

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the exclusions above apply to the maximum extent permitted by law.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOOSTLINK NETWORK, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, MARKETING PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATING TO:

• Your access to, use of, or inability to use the Site;
• The acts, omissions, conduct, workmanship, pricing, or failure to perform of any service provider or third party;
• Any property damage, personal injury, or economic loss arising from work performed or not performed by a provider;
• Any reliance on information or content made available through the Site;
• Unauthorised access to or alteration of your transmissions or information;
• Any delay or failure to connect you with a service provider;

WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, WARRANTY, STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless BoostLink Network and its owners, officers, directors, employees, agents, affiliates, marketing partners, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site; (b) your breach of these Terms; (c) any information you submit that is false, inaccurate, or provided without authorisation; (d) your violation of any applicable law or the rights of any third party; or (e) any dispute between you and any service provider.

15. Dispute Resolution

Informal resolution. Before filing any formal proceeding, you agree to contact us at boostlinknetwork@gmail.com and attempt in good faith to resolve any dispute informally for a period of at least thirty (30) days.

Binding arbitration. Except where prohibited by applicable law, any dispute arising out of or relating to these Terms or the Site that cannot be resolved informally shall be resolved by final and binding arbitration administered in the United States in accordance with the rules of a recognised arbitration body, on an individual basis. The arbitrator's award shall be final and may be entered as a judgment in any court of competent jurisdiction.

Class action waiver. To the fullest extent permitted by applicable law, you and BoostLink Network agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Exceptions. Either party may seek relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights, or to enforce an arbitration award. You may also bring a claim in small claims court if it qualifies. Nothing in this Section waives any right you may have under applicable law that cannot be waived.

16. Governing Law

These Terms and any dispute arising out of or relating to them or to the Site shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of laws principles. Subject to Section 15, you and BoostLink Network consent to the exclusive jurisdiction and venue of the state and federal courts located in the State of Delaware for any proceeding not subject to arbitration.

The Site is operated from and intended for use within the United States. We make no representation that the Site or its content is appropriate or available for use in other locations. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local law.

17. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Material changes will be accompanied by additional notice on the Site where appropriate. Your continued use of the Site after revised Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.

18. General Provisions

• Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and BoostLink Network regarding the Site and supersede all prior agreements and understandings.
• Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
• No waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or of our right to enforce it later.
• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
• Survival. Sections 6 through 18 survive termination of these Terms and your use of the Site.
• Headings. Section headings are for convenience only and do not affect interpretation.
